1. General

These Terms and Conditions govern your use of the website www.B2B.cykero.eu operated by Cykero GmbH, registered under HRB221684 with VAT number DE338207650, located at Schillstrasse 9, 10785 Berlin, Germany. By accessing and using our website, you agree to these Terms and Conditions. If you do not agree, please do not use our services.

2. Eligibility

You must be at least 18 years old to use our services. By using our website, you confirm that you meet this eligibility requirement.

3. Orders and Payments

When you place an order with us, you agree to purchase the products listed in your order. All prices are in Euro and exclude VAT. Payment must be made using one of the accepted methods: credit card, PayPal, deferred payment (Hokodo), or instant bank transfer (Bridge). Orders will be processed within 24 hours of payment confirmation. If any product is unavailable, we will notify you immediately, and you will have the option to modify or cancel your order.

4. Retention of Title

Cykero GmbH retains full ownership of the goods until the complete purchase price, including any expenses and claims, has been paid by the buyer.

5. Delivery and Transfer of Risk

We ship exclusively within the European Union. The risk for the goods passes to the customer when the goods are handed over to the shipping carrier for delivery. Cykero GmbH is not responsible for any damage or loss occurring during shipment. The shipping times and methods are as follows:

• Standard Shipping: 3-5 business days
• Express Shipping: 1-2 business days

All shipments are fully insured by Cykero GmbH. Tracking information will be provided via email once your order is shipped.

6. Fulfillment of Orders

Cykero GmbH aims to fulfill orders promptly. However, all deliveries are subject to availability and factors such as order volumes, stock levels, and payment receipt. Cykero reserves the right to fulfill partial orders or delay shipments if stock availability changes after an order is placed. Any changes will be communicated to you.

If goods are delayed for reasons beyond Cykero's control (such as supplier delays or unforeseen issues), we will notify you immediately. Delivery dates are considered estimates and not guaranteed.

Cykero GmbH shall not be liable for any delays or non-fulfillment due to unforeseen circumstances beyond its control, including but not limited to strikes, natural disasters, or transportation disruptions.

7. Inspection of Goods

Customers are required to inspect goods upon delivery and report any defects within 5 working days. Failure to notify us within this period will result in the goods being considered accepted.

8. Cancellations and Modifications

Orders may only be canceled or modified with prior written agreement. Any costs incurred due to cancellations or changes will be charged to the customer.

9. Returns and Refunds

Returns are only accepted for warranty-related issues as outlined in our Return and Refund Policy. No returns are allowed without prior written approval from rma@cykero.eu. Products must be returned within 5 working days after receiving return approval.

10. Warranty

We offer a 72-hour cosmetic warranty and a 30-calendar-day functional warranty on all refurbished products. The warranty excludes damages caused by misuse, wear and tear, and third-party repairs. For more details, refer to our Warranty Policy.

11. Intellectual Property

All content on this website, including logos, images, text, and product descriptions, is the intellectual property of Cykero GmbH or its licensors. You may not use, reproduce, or distribute any content without our prior written consent.

12. User Responsibilities

You agree to use this website in a lawful manner and not to engage in any activities that may harm the website or its users. This includes refraining from hacking, uploading malicious software, or using the website to violate any local, national, or international laws.

13. Limitation of Liability

Cykero GmbH will not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use our products or website. In no case shall Cykero GmbH’s liability exceed the amount paid for the product in question.

14. Force Majeure

Cykero GmbH is not liable for any delay or failure to fulfill its obligations due to circumstances beyond its control, including but not limited to natural disasters, strikes, or government actions. If a force majeure event lasts for more than 60 days, either party may terminate the contract without further liability.

15. Defects and Complaints

Customers must report any defects within 5 working days of discovering them. Cykero GmbH will either repair or replace defective goods, or issue a refund, at our discretion. Products that have been altered or repaired by the customer or a third party without Cykero's consent are not eligible for return or refund.

16. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Germany. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany.

17. Amendments

Cykero GmbH reserves the right to amend or update these Terms and Conditions at any time. Changes will be posted on this page, and your continued use of the website following any changes signifies your acceptance of the updated terms.
